1. ACCEPTANCE OF TERMS

Welcome to Transform 75 by Sikora ("Transform 75," "the App," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Transform 75 mobile application and any related services. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date above and notify you through the App or other appropriate means. Your continued use of the App after any modifications constitutes your acceptance of the revised Terms.

2. ELIGIBILITY

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using the App, you represent and warrant that you meet the eligibility requirements stated above and that you have the legal capacity to enter into these Terms.

3. DESCRIPTION OF THE APP

Transform 75 is a fitness challenge tracker application designed to help users complete the 75 Hard mental toughness program or similar customizable fitness challenges. The App provides tools for daily task tracking, progress photo documentation, journaling, streak monitoring, push notification reminders, and optional iCloud synchronization across Apple devices.

Transform 75 is a tracking and accountability tool only. The App does not provide medical advice, fitness training, dietary guidance, or any form of professional health consultation.

4. ACCOUNT AND DEVICE ACCESS

4.1 Apple ID and iCloud

Certain features of the App may require you to be signed in with an Apple ID. If you enable iCloud synchronization, your data will be synced through Apple's CloudKit service and is subject to Apple's terms and conditions. You are responsible for maintaining the security of your Apple ID and any activity that occurs under your account.

4.2 Your Responsibilities

You agree to:

- Provide accurate information when using the App.

- Maintain the security of your device and account credentials.

- Notify us immediately if you suspect unauthorized access to your data through the App.

- Use the App only for its intended purpose as a personal fitness challenge tracker.

5. USER CONTENT

5.1 Ownership

You retain full ownership of all content you create, upload, or store through the App, including progress photos, journal entries, personal goals, and challenge data ("User Content"). We do not claim any ownership rights over your User Content.

5.2 License to Us

By using the App, you grant us a limited, non-exclusive, royalty-free license to process and store your User Content solely for the purpose of providing and improving the App's functionality. This license terminates when you delete your User Content or your account.

5.3 Your Responsibility for User Content

You are solely responsible for your User Content. You agree that your User Content will not:

- Violate any applicable law or regulation.

- Infringe upon the intellectual property or privacy rights of any third party.

- Contain any harmful, abusive, defamatory, or objectionable material.

If the App includes social or competitive features, any content you share publicly is your responsibility. We reserve the right to remove any User Content that violates these Terms.

6. HEALTH AND FITNESS DISCLAIMER

IMPORTANT — PLEASE READ CAREFULLY:

Transform 75 is a challenge tracking tool and does NOT provide medical advice, exercise prescriptions, dietary plans, or any form of health or wellness guidance. The 75 Hard challenge and any similar fitness programs involve strenuous physical activity and dietary restrictions that may not be appropriate for everyone.

- Consult your physician or qualified healthcare provider before beginning any fitness challenge, exercise program, or dietary change, especially if you have any pre-existing medical conditions, injuries, or health concerns.

- You acknowledge that participating in any fitness challenge carries inherent risks, including but not limited to physical injury, overexertion, dehydration, and other health complications.

- The App is not a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of something related to your use of the App.

- You assume full responsibility for your health and safety while using the App and participating in any fitness challenge.

WE ARE NOT LIABLE FOR ANY INJURY, ILLNESS, DAMAGE, OR DEATH RESULTING FROM YOUR USE OF THE APP OR PARTICIPATION IN ANY FITNESS CHALLENGE TRACKED THROUGH THE APP.

7. INTELLECTUAL PROPERTY

7.1 Our Intellectual Property

The App, including its design, code, graphics, user interface, logos, trademarks, and all other proprietary content (excluding User Content), is owned by Transform 75 by Sikora and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or its content without our prior written consent.

7.2 The 75 Hard Program

The 75 Hard program was created by Andy Frisella. Transform 75 by Sikora is an independent tracking application and is not affiliated with, endorsed by, or sponsored by Andy Frisella or any entity associated with the 75 Hard program. All references to the 75 Hard challenge are for descriptive purposes only.

7.3 Feedback

If you provide us with suggestions, ideas, or feedback regarding the App ("Feedback"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, modify, and incorporate such Feedback into the App without any obligation or compensation to you.

8. PROHIBITED USES

You agree not to:

- Use the App for any unlawful purpose or in violation of any applicable law or regulation.

- Attempt to reverse engineer, decompile, disassemble, or otherwise extract the source code of the App.

- Interfere with or disrupt the App's functionality, servers, or networks.

- Attempt to gain unauthorized access to any part of the App, other user accounts, or any systems or networks connected to the App.

- Use the App to transmit any viruses, malware, or other harmful code.

- Use automated scripts, bots, or other tools to access or interact with the App.

- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.

- Use the App in any manner that could damage, disable, overburden, or impair the App.

- Exploit any social or competitive features to harass, bully, or intimidate other users.

We reserve the right to suspend or terminate your access to the App if you engage in any prohibited uses.

9. IN-APP PURCHASES AND SUBSCRIPTIONS

9.1 Pricing

The App may offer free and paid features, including one-time purchases or subscription plans. All pricing is displayed within the App and is subject to change. Prices may vary by region and are listed in your local currency as determined by the App Store.

9.2 Payment Processing

All purchases are processed through Apple's App Store. By making a purchase, you agree to Apple's terms and conditions for in-app purchases. We do not directly collect or store any payment information.

9.3 Subscriptions

If the App offers subscription plans:

- Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.

- You can manage and cancel subscriptions through your Apple ID account settings.

- No refunds will be provided for the current billing period upon cancellation.

9.4 Refunds

Refund requests are handled by Apple in accordance with their refund policies. To request a refund, visit reportaproblem.apple.com or contact Apple Support.

10. THIRD-PARTY SERVICES

The App may integrate with or contain links to third-party services, including Apple's iCloud, CloudKit, and App Store services. These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, functionality, or practices of any third-party services. Your use of third-party services is at your own risk.

11. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

- WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE APP.

- WARRANTIES THAT THE APP WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.

YOUR USE OF THE APP IS AT YOUR SOLE RISK.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRANSFORM 75 BY SIKORA, ITS DEVELOPER, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

- ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

- ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

- ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.

- ANY DAMAGES ARISING FROM ANY THIRD-PARTY SERVICES ACCESSED THROUGH THE APP.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO US FOR USE OF THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Transform 75 by Sikora, its developer, affiliates, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

- Your use of the App.

- Your violation of these Terms.

- Your violation of any applicable law or the rights of any third party.

- Your User Content.

- Your participation in any fitness challenge tracked through the App.

14. TERMINATION

14.1 By You

You may stop using the App at any time and delete it from your device. To delete your data, you can do so within the App or by managing your iCloud settings.

14.2 By Us

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms or conduct that we determine to be harmful to other users or the App.

14.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination will continue in effect, including but not limited to: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall first be attempted to be resolved through good faith informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through binding arbitration or in the courts of competent jurisdiction in Philadelphia, Pennsylvania.

15.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND THAT YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING.

16. GENERAL PROVISIONS

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Transform 75 by Sikora regarding your use of the App and supersede any prior agreements.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, or pandemics.
